By registering and using giganizr.com, you accept these Terms of Service. Deviating terms of the user are not recognized unless we expressly agree to their validity in writing.

giganizr.com is a web-based platform for musicians, bands, and event companies. The platform offers the following core features:

• Song and repertoire management
• Creation and management of setlists
• Concert and event planning
• Creation of quotations, invoices, and business documents
• Customer and contact management
• Team collaboration with roles and permissions
• Integrations (Google Calendar, iCal feeds, etc.)

The exact services depend on the selected subscription and may change as part of ongoing development.

Registration is required to use giganizr.com. By registering, you confirm that:

• You are at least 16 years old
• Your information is complete and accurate
• You are authorized to act on behalf of any band or organization

You are responsible for keeping your login credentials confidential. All activities performed through your account are attributed to you. Please inform us immediately if you suspect unauthorized use.

Each natural person may only have one user account. Creating multiple accounts is not permitted.

We strive to maintain high platform availability. However, there is no guarantee of uninterrupted availability. Maintenance and technical issues may cause temporary outages.

We reserve the right to modify, expand, or discontinue platform features. We will notify you in advance of significant restrictions to paid features.

Support is primarily provided via email (support@giganizr.com). No response time is guaranteed.

giganizr.com offers various subscription tiers. Current prices and included services can be found on our pricing page.

Payment is processed through the payment service provider Stripe. By subscribing to a paid plan, you authorize recurring charges.

Paid subscriptions automatically renew for the respective billing period (month or year) unless you cancel before the end of the term.

Cancellation is possible at any time effective at the end of the current term. Amounts already paid are not refunded on a pro-rata basis.

Price changes will be announced at least 30 days before they take effect and apply from the next renewal.

As a user, you agree to:

• Use the platform only for legally permissible purposes
• Not upload content that violates applicable law or infringes third-party rights
• Not misuse the platform (e.g., mass email sending, unauthorized automated access)
• Not attempt to manipulate the platform or circumvent its security
• Only enter truthful data, especially in business documents

In case of violations of these obligations, we reserve the right to temporarily suspend or permanently delete your account.

You are solely responsible for compliance with all copyright regulations regarding the musical works stored in your account. This includes in particular:

• Reporting obligations to collecting societies (e.g., GEMA, PRS, ASCAP) for public performances
• Obtaining required licenses for copyrighted works
• Observing rights to lyrics, sheet music, and arrangements

giganizr.com does not handle registrations with collecting societies and does not perform copyright checks.

You indemnify us against all third-party claims arising from copyright infringement through your use.

You retain all rights to the content you upload (songs, setlists, documents, etc.).

By uploading, you grant us the right to store, process, and display this content solely for the purpose of providing our services.

You are solely responsible for the legality and accuracy of your content.

You are responsible for the distribution of publicly shared content (e.g., quotations via token links).

Invoices, quotations, and other business documents created with giganizr.com are generated based on your input.

You are solely responsible for:

• The accuracy of all information (prices, tax rates, addresses, service descriptions)
• Compliance with tax regulations
• Proper invoicing according to applicable laws
• Retention of documents according to legal requirements

giganizr.com does not verify the content, tax, or legal correctness of generated documents. Use is at your own risk.

The document features do not replace tax or legal advice.

The protection of your personal data is important to us. Information about the processing of your data can be found in our Privacy Policy.

We are fully liable for damages resulting from injury to life, body, or health, as well as for damages caused intentionally or through gross negligence.

In cases of slight negligence, we are only liable for breach of essential contractual obligations (cardinal obligations) and only up to the amount of the subscription fee paid in the last month before the damage occurred.

We are not liable for:

• Loss of data due to technical failures
• Temporary unavailability of the platform
• Data loss at third-party services (Google Calendar, Stripe, etc.)
• Damages caused by incorrect user input

You are responsible for regular backups of your important data. The export functions allow you to back up your content at any time.

Liability for indirect damages, lost profits, and consequential damages is excluded to the extent permitted by law.

giganizr.com uses the following third-party services:

We do not guarantee the availability or privacy practices of these services. Use of integrations is at your own risk.

Changes or discontinuation of third-party services may result in feature limitations.

You can delete your account at any time in the account settings. Paid subscriptions end at the conclusion of the paid term.

We may suspend or terminate your access in case of:

• Significant violations of these Terms of Service
• Use for illegal purposes
• Payment default exceeding 30 days
• Prolonged inactivity (after prior notification)

Before your account is deleted, you have the opportunity to export your data.

After termination, your data will be deleted in accordance with our Privacy Policy, unless legal retention obligations apply.

We reserve the right to modify these Terms of Service. We will inform you of significant changes at least 30 days before they take effect via email.

If you do not agree to the changes, you may object within this period. In this case, the contract ends when the changes take effect.

Continued use after the changes take effect constitutes acceptance of the modified terms.

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods.

The place of jurisdiction is, to the extent permitted by law, the operator's registered office.

Should individual provisions of these Terms of Service be or become invalid, the validity of the remaining provisions remains unaffected.

These Terms of Service, together with the Privacy Policy, constitute the entire agreement between you and us regarding the use of giganizr.com.
